1. Agreement to Terms
By accessing and using ForestWay Hiking's services, website, or booking any hiking tours, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. The materials and services contained in this website are protected by applicable copyright and trademark law.
These terms apply to all visitors, users, and others who access or use the service. By using our services, you represent that you are at least 18 years of age or have the consent of a legal guardian. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.
2. Booking and Reservations
All bookings made through ForestWay Hiking are subject to availability and confirmation. When you make a reservation, you agree to provide accurate, current, and complete information about yourself as prompted by our booking forms. We reserve the right to refuse service, terminate accounts, or cancel bookings at our sole discretion, particularly if we believe the information provided is inaccurate or misleading.
Payment is required at the time of booking unless otherwise specified. All prices are quoted in Australian Dollars (AUD) and are subject to change without notice. Once a booking is confirmed, you will receive a confirmation email with details of your tour, including date, time, meeting location, and any special requirements or equipment needed.
3. Cancellation and Refund Policy
Cancellations made more than 14 days prior to the scheduled tour date are eligible for a full refund minus a 10% administrative fee. Cancellations made between 7-14 days before the tour date will receive a 50% refund. Cancellations made less than 7 days before the tour date are non-refundable. In the event that ForestWay Hiking must cancel a tour due to weather conditions, safety concerns, or insufficient participants, a full refund or rescheduling option will be offered.
We strongly recommend purchasing travel insurance to protect your investment against unforeseen circumstances. Refunds will be processed within 14 business days to the original payment method. No-shows or late arrivals resulting in missed tours are not eligible for refunds or rescheduling.
4. Health and Safety Requirements
Participants must be in good physical health and capable of completing the selected hiking tour. You are required to disclose any medical conditions, injuries, or physical limitations that may affect your ability to safely participate. ForestWay Hiking reserves the right to exclude any participant deemed unfit for a particular tour based on safety considerations.
All participants must follow the instructions and guidance of our professional hiking guides at all times. Failure to comply with safety instructions may result in removal from the tour without refund. Participants are responsible for bringing appropriate clothing, footwear, and personal items as specified in the tour requirements. We are not liable for injuries, accidents, or losses resulting from failure to follow safety guidelines or guide instructions.
5. Assumption of Risk and Liability
Hiking and outdoor activities involve inherent risks including but not limited to: uneven terrain, weather changes, wildlife encounters, physical exertion, and potential injury. By participating in ForestWay Hiking tours, you acknowledge these risks and voluntarily assume all risks associated with participation, whether known or unknown.
To the fullest extent permitted by law, ForestWay Hiking, its owners, employees, guides, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services or participation in tours. This includes but is not limited to personal injury, property damage, or loss of belongings. Participants are strongly encouraged to obtain comprehensive travel and medical insurance.
6. Photography and Media Release
During tours, ForestWay Hiking may take photographs or videos for marketing, promotional, or educational purposes. By participating in our tours, you grant us permission to use your likeness in such materials without compensation. If you do not wish to be photographed, please inform your guide at the beginning of the tour.
You retain all rights to personal photographs and videos you take during tours. However, we ask that you respect the privacy of other participants and obtain consent before sharing images featuring others on social media or public platforms.
7. Environmental Responsibility
All participants are expected to follow Leave No Trace principles and respect the natural environment. This includes staying on designated trails, properly disposing of waste, not disturbing wildlife or vegetation, and minimizing environmental impact. Participants who violate environmental protection rules may be removed from tours and reported to appropriate authorities.
We operate under permits from national parks and conservation areas. Any behavior that jeopardizes these permits or violates park regulations is strictly prohibited and may result in legal consequences for the individual.
8. Intellectual Property Rights
All content on the ForestWay Hiking website, including text, graphics, logos, images, and software, is the property of ForestWay Hiking or its content suppliers and is protected by Australian and international copyright laws. Unauthorized use, reproduction, or distribution of this content is prohibited.
The ForestWay Hiking name, logo, and related marks are trademarks and may not be used without express written permission. Any unauthorized use may violate copyright, trademark, and other applicable laws.
9. Code of Conduct
All participants are expected to behave respectfully toward guides, other participants, and the natural environment. Harassment, discrimination, intoxication, or disruptive behavior will not be tolerated and may result in immediate removal from the tour without refund.
We maintain a zero-tolerance policy for behavior that endangers the safety or enjoyment of others. This includes but is not limited to: reckless behavior, ignoring safety instructions, substance abuse during tours, or any form of harassment or offensive conduct.
10. Privacy and Data Protection
Your privacy is important to us. All personal information collected during the booking process is handled in accordance with our Privacy Policy and applicable data protection laws. We collect only the information necessary to provide services and improve your experience.

11. Force Majeure
ForestWay Hiking shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, severe weather, fires, floods, earthquakes, pandemics, government actions, strikes, or other labor disputes.
In such events, we will make reasonable efforts to reschedule tours or provide alternative arrangements. If rescheduling is not possible, refunds or credit toward future tours will be offered at our discretion.
12. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Perth, Western Australia.
We encourage resolution of disputes through direct communication. If you have concerns or complaints, please contact us first to seek an amicable resolution before pursuing legal action.
13. Amendments and Updates
ForestWay Hiking reserves the right to modify or replace these Terms of Service at any time at our sole discretion. Material changes will be notified through our website or via email to registered users. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
